as far as i know, all the cars, esp taxi have insurance - Third Party, Comprehensive plan, and theft and fire etc...

the 第三者责任险 should be compulsory (as far as I can remember) , and it includes the third party （include passenger）索偿 , so if anything happens to the passenger of the taxi, the passenger can ask the taxi driver to 赔偿 and the taxi driver can ask the insurance agent to 理赔

of course, with all kinds of receipt, it is easier to settle the 索偿额。and most of the time, insurance 理赔 happens after the 乘客 is discharged from hospital becasue at that time, all exact figures come out.

MY suggestion - You can call any insurance company or the agent and tell them you are interested to purchase some policies, for instance, accident policy. And then when meeting, can ask more details, like who should you ask for remedy? how long will it take etc…

你的case 看起来是accident,“ 如果出错的是不是taxi而是van”

首先，taxi passenger （你们）是否有保险，accident or hospital？如果有，可以通知你们的保险公司要求赔偿，如果没有（估计你们是这种情况），私下觉得，主要的问题是你们应该向谁claim？

虽然表面看起来，你们应该是可以和taxi or van ask for remedy的，但是实际上如果操作，不得而知。因此，

那么首先，你们所有的因这次accident 的支出的单据，要收好并且至少保留一份原始复印件 – keep one copy with you 。无论任何方要求你们出具原件，都要求对方签收（这是为了保护你们自己，所以，可以复印一份，要求对方在复印件上签个名）。当然，态度要好

其次，一般情况下，taxi passenger你们是无责任方，所以你们可以要求全额赔偿，你的case就是医药费，出事之时还有其他东西丢失或者损坏，误工费（if applicable），有的一个月之后还得去医院复诊的费用，不过，你们是否可以得到全额赔偿，就是后话了，但是只要有要求，就要claim,谋事在人，成事在天嘛

至于你们几个人不同情况，有点复杂，通常保险公司是在入院的人discharge 后才开始理赔，如果有pre & post hospital claim，case by case 是否先理赔discharge 之前的费用还是一次性等“所有的医疗全部结束之后才一起解决”。如上所言，如果你们希望先理赔一部分，至少你们可以告诉保险公司你们的意愿，注意同时提出你们的原因／难处，要诚恳有说服力.就是尽量首先提出what you want and need

关于“过程会很慢，可能需要半年或者一年才能拿到我们的医药费”通常保险合同会规定理赔事项，所以可以查问van or taxi保险合同会规定，此外，一般业界都有一套规定，什么类型的理赔大概时间是多长，保险经济应该知道的

还有几点关于保险的，和你们索赔没有直接关系，但是了解一下也无妨

As far as I know, there are two types of third party car insurance,
如果购买的第三者责任险是人身伤亡责任险，那么第三方车辆和财物损失是不予赔偿的，只有购买了第三者综合险才会得到赔偿。就是说“事之时还有其他东西丢失或者损坏，误工费（if applicable）”是否可以得到赔偿，要看van or taxi投保的是什么险。

其次，一般保险公司都会告诉投保人(van or taxi)先行支付third party的费用，然后才claim，但是由于保险公司一般不可能全额claim投保人的支出（车险通常有免赔率,举个例子说，负全责20%，主责15%，同等责任10%，次要责任5%，即是最高才赔偿95% - Example only, please do not refer the figure as part of any real policy），通常投保人都会等到保险公司确认后才会支付third party，所以时间就会比较长
